1    GENERAL

1.1  Application shall be made in writing annually if a mobile food van is to be used within the area.

1.2  Licensing shall be subject to a satisfactory report by Council's Environmental Health Officer to the effect that the vehicle fully complies with Council's requirements.

1.3  The vehicle shall be presented to Council annually for reinspection.

1.4  This licence shall be kept in the mobile food van at all times.

1.5  Vehicles must also comply with the requirements of the NSW Roads and Traffic Authority regarding "Children Warning Signs and Flashing Lights".

1.6  Vehicles must also comply with normal traffic regulations and parking restrictions.

1.7  The operation of the van within a public reserve, park, oval or other Council controlled area is not permitted unless approved by Council and the prescribed fee paid. The receipt should be presented to Council's caretaker of the ground or other authorised person.

1.8  The entry and location of the van within a public reserve, park, oval or other Council controlled area shall be in accordance with the directions of Council's caretaker of the ground, or other authorised person.

2    LEGAL

2.1  No person is permitted to set up or use any standing vehicle or stall within the Ku-ring-gai area, for the purpose of offering for sale any article of food, unless such person or vehicle is approved by Council for that purpose, under the provisions of Part 1, Section 68, of the Local Government Act 1993.

2.2  The vehicle and its operation shall comply with Council's Mobile Food Van Code, the Food Act 2003, Food Standards Code and other conditions as may be specified.

2.3  The operation of the mobile food van on a public roadway shall comply with the following requirements;

(a)  A person shall not in any road set up or use any standing vehicle for the purpose of offering for sale any article, or for the pursuit of any business.

(b)  A person shall not (for the purpose of selling) occupy any one position in a public road with a vehicle, except for such period of time as he may be engaged in the actual serving of a customer. He shall then forthwith after serving a customer, pass on, and shall not return soliciting custom or selling over the same ground within one hour.

(c)  Operation of the van within public roads is to be restricted to streets which are light trafficked and vending is prohibited in arterial, sub-arterial or collector roads as defined in Council's road hierarchy.

2.4  Amplified music and/or "noise device" for the purpose of informing members of the public that articles are on sale from the vehicle shall not be used or operated in any public place:

(a)  While the vehicle is stationary; or

(b)  Before 8:00am or after 8:00pm on any day: or

(c)  For longer than thirty (30) seconds in any period of three (3) minutes: or

(d)  More than once in any period of one (1) hour in the same road between the same two roads which are nearest in each direction and which intersect with the road.


3    CONSTRUCTION

3.1  The driving compartment to be separated from the food preparation, storage or sales area in a permanent manner acceptable to Council's Environmental Health Officer.

3.2  The floor of the food preparation, storage and sales area shall be continuous vinyl sheeting (or other approved material) suitably weld-jointed and coved to all vertical intersections at a minimum 25mm radius.

3.3  The walls and ceiling of the food preparation, storage and sales area shall be of smooth impervious material capable of being washed or otherwise kept clean.

3.4  Benches, cupboards, shelves and other such equipment is to be installed in accordance with Standard 3.2.3 of the Food Standards Code.

3.5  Cooking equipment is to be installed in accordance with Standard 3.2.3 of the Food Standards Code.

3.6  The vehicle is to be provided with a fresh water supply tank of sufficient quantity to enable hand cleansing and washing of equipment and fittings over a normal day's operation, and a waste water tank (of at least equal capacity).

3.7  The vehicle is to be fitted with a hand basin with soap, paper towels and a nail brush provided, together with a sink for washing equipment, utensils and the like.

3.8  An adequate supply of hot water is to be provided to the sink and hand basin in all cases where food is prepared or cooked within the vehicle.

3.9  Appliances for the storage of perishable foods shall be provided which are capable of keeping cold foods below 5oC or hot food above 60oC. Thermometers accurate to 1Co shall be provided to enable frequent checks of the temperatures, in accordance with Standard 3.2.2 of the Food Standards Code.

3.10  Cooking facilities are to be mechanically or naturally ventilated to the satisfaction of Council's Environmental Health Officer.

3.11  All compressors, power generators, mechanical ventilation equipment and the like are to be sound-proofed to the satisfaction of Council's Environmental Health Officer.

3.12  All electrically powered machinery and equipment within the mobile food van shall be capable of being connected to a 240v mains supply when and where available.

3.13  An adequate number of garbage receptacles to be provided for collection of waste originating from the business. Arrangements for the proper disposal of this waste.
